Terms and Conditions of Sale

The Terms and Conditions stated herein apply to the sales of all products by TRIPLEX INTERIORES UNIPESSOAL LDA – CASA MAGNA. The present Terms and Conditions shall govern all orders placed with CASA MAGNA by the Customer. CASA MAGNA hereby rejects any Terms and Conditions that are in addition to the Terms and Conditions stated herein.

1. QUOTATIONS

Unless otherwise satted, all CASA MAGNA quotations are authorised for a period of thrity days from the date of issue. All quotations of product shall be Ex-Works Paços de Ferreira, Portugal. All Shipping and insurance costs will be the responsability of the Customer.

 

2. PRICES AND PAYMENTS

Prices are subject to change. CASA MAGNA reservs the right, without prior notice, of modifying, discontinue or change prices of products. All prices refer to a single unit and are Ex-Works* Paços de Ferreira, Portugal, excluding VAT. Packaging are always included in the price provided. If the customer requires a specific packaging, it will be charged accordingly.

There is a minimum required for the first order of €3.500. 50% down payment is due on the Order Confirmation and the 50% balance payment for the whole order befor shipment. Payments should be made by the Customer to the account provided in the invoice and within the invoice’s valid period. Unless otherwise specified, payments shall bem made in Euros by wire transfer.

*Ex-Works (EXW) is a shipping arrangement in which a seller makes a product available at a specific location, but the buyer is responsible for the transport costs.

 

3. PRODUCTION TIME

The lead time for catalog orders is 10-12 weeks, excluding transport time. For custom products, in dimensions, shape or finishes, a specific lead time will be provided accordingly. The date of delivery is an approximation of the date of delivery, not a guarantee of the exact delivery date. Delivery lead time only starts to run when all the technical questions have been clarified and the customer has fulfilled any of its obligations (including providing full billing address and confirming 50% down payment on the whole order to activate production.

 

4. CANCELLATIONS

The Order Confirmations received by the customer is not subject to cancellation, changes or reductions in amount, once the order and down payment have been confirmed.

 

5. FINISHING OPTIONS AND VARIATIONS

All finishing materials must be chosen by the customer prior to the Order Confirmation. The production is made considering the references, dimensions and details chosen by the customer and included in the Order Confirmation.
There may be variations in the natural derivations of finishes, like the woods, natural leathers, fabrics and stones. In addition, digital or printed image colours can also diverge from the originals.

 

6. FREIGHT DAMAGES AND COMPLAINTS

All products are carefully packed and inspected prior to shipment. CASA MAGNA provides Ex-Works service and is not responsible for any loss or damage during the transport. Upon request, CASA MAGNA may assist clients with estimated shipping costs from a specialized shipping company in order to facilitate the negotiation, considering Ex-Works terms, and it is not responsible for any damages occurred during the loading, shipment and unload of the goods. The goods are collected from the CASA MAGNA’s warehouse by the buyer and will travel in carriage with other goods of different natures. If the customer requires a different form of transportation, the additional costs involved in this process will be his responsibility. All quotes provided by Casa Magna are of a door-to-door nature. If the client wishes otherwise, they must first inform CASA MAGNA. All deliveries made by the carrier arranged by Casa Magna are made up to r/c of the delivery address (main door). The loading of the volumes into the warehouse or domicile is done by the buyer. If the buyer refuses delivery of the packages, presented in perfect conditions (packaging), all costs of storage and new delivery will be borne by the buyer. Any achange in the delivery address, without prior notice given to Casa Magna at least 7 business days before dispatch of the goods, may cause a delay in delivery as well as extra costs, which will be charged to the buyer.

 

7. ACCEPTANCE OF GOODS

When goods are received, client’s signature is required. Any damage during shipping of the goods should be addressed to CASA MAGNA within 5 working days of the delivery and acceptance of the goods. All complaints referred to evident damages or quality flaws will be solved by repairing or replacing the damaged item. Casa Magna will not take responsability for any reimbursement of expenses or damages linked to a complaint. CASA MAGNA will not take responsability for any type of covers made of fabric or leather or any other material sent by the customer to our production.
